These Terms of Service (“Terms”) are a binding agreement between you and Think Compared Ltd (“Think Compared”, “we”, “us”), the company behind Daffo, governing your use of the Daffo website and mobile app (together, the “Service”). Please read them, together with our Privacy Policy.
Acceptance of these terms
By creating an account, joining the waitlist, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use the Service. Where you are under the age of digital consent in your country (which can be up to 16), you confirm that a parent or guardian has consented on your behalf as required by law. By using the Service you confirm you meet these requirements and can form a binding contract.
Your account
You are responsible for your account and for keeping your credentials secure. Provide accurate information and tell us promptly of any unauthorised use. You are responsible for activity under your account.
Licence to use the Service
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use. We may update, suspend or discontinue features.
Your content
You keep ownership of the content you post (text, images, video, reviews, and similar — “User Content”). You grant Think Compared a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute your User Content for the purpose of operating, promoting and improving the Service. This licence ends when you delete your User Content or account, except for copies retained for legal reasons or already shared with others.
You confirm you have the rights to your User Content and that it does not infringe anyone’s rights or break the law.
Acceptable use
You agree not to post content or behave in ways that:
- are illegal, or promote illegal activity;
- harass, bully, threaten, defame, or incite hatred or violence against others;
- are sexually explicit, or sexualise or endanger minors;
- infringe intellectual-property, privacy or other rights, or impersonate others;
- are spam, scams, malware, or attempts to disrupt or game the Service;
- misuse another person’s data or our tracking/inbox features.
We may remove content and restrict or suspend accounts that breach these rules. These rules form part of our agreement with you and apply to all users of the app.
Moderation, reporting and appeals
You can report content or users you believe break these Terms or the law using the in-app reporting tools or by emailing hello@daffo.app, and you can block or mute other users.
When we act on content — for example, removing it or restricting an account — we aim to give the affected user a clear statement of reasons and a way to appeal the decision, in line with applicable law including the EU Digital Services Act. We do not knowingly host illegal content and act on valid notices.
Shopping & commerce
Daffo is a social layer over online shopping. We help you discover, track and follow products and brands across third-party retailers. We are an intermediary only:
- the seller is the relevant retailer, not Daffo. Your purchase is a contract between you and that retailer and is governed by their own terms and policies;
- Daffo does not take payment and is not the merchant of record; checkout and payment happen on the retailer’s own site;
- prices, availability and product information come from third parties and may be inaccurate or out of date — always check on the retailer’s site before buying.
Intellectual property
The Service, including the Daffo name, logo, design and software, is owned by us or our licensors and protected by law. We grant you no rights in it except as set out here. Third-party brand names and logos shown in the Service belong to their owners and are used for identification only; their appearance does not imply endorsement or partnership.
Third-party content & links
The Service contains content, links and integrations from third parties. We are not responsible for third-party sites, products or content, and your use of them is at your own risk and subject to their terms.
Disclaimers
The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim implied warranties. We do not guarantee that tracking, alerts, prices, availability or order information will be accurate, timely or uninterrupted. Nothing in these Terms excludes liability that cannot be excluded by law, including your statutory consumer rights.
Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from third-party retailers, missed alerts, or inaccurate pricing or availability. Our total liability to you for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) £100. We do not limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
You agree to indemnify us against claims arising from your User Content or your breach of these Terms, to the extent permitted by law.
Suspension, termination & account deletion
You can stop using the Service at any time and delete your account from within the app, which deletes or anonymises your personal data as described in the Privacy Policy (subject to legal retention). We may suspend or end your access if you breach these Terms or to protect the Service and its users.
App store terms
If you download the app from a third-party app store, that store’s terms also apply. For Apple’s App Store, these Terms are between you and Think Compared (not Apple); Apple is not responsible for the app or its support, and Apple and its subsidiaries are third-party beneficiaries entitled to enforce these Terms. You confirm you are not located in an embargoed jurisdiction or on a prohibited-parties list.
Changes to these terms
We may update these Terms. We will post the new version with an updated date and, for material changes, give additional notice. Continued use after changes means you accept them.
Governing law & disputes
These Terms are governed by the laws of England & Wales, and the courts of England & Wales have jurisdiction, without affecting any mandatory consumer-protection rights you have where you live.
